Elevate Family Martial Arts

Welcome to Elevate Family Martial Arts. These Terms and Conditions (“Terms”) govern your use of our website located at https://www.elevatefamilymartialarts.com and your participation in our martial arts programs and services. By accessing our website or enrolling in any of our programs, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
 

1. Definitions

  • “We,” “us,” or “our” refers to Elevate Family Martial Arts, located at 3075 SE Century Blvd., Suite 103, Hillsboro, Oregon 97123.

  • “You” or “your” refers to any individual accessing our website or enrolling in our programs, including parents or legal guardians acting on behalf of minor students.

  • “Student” refers to any individual enrolled in our martial arts classes, regardless of age.

  • “Services” refers to all martial arts instruction, classes, programs, events, and related activities offered by us.
     

2. Eligibility and Enrollment

Our programs are open to students of various ages, including children as young as 3½ years old. For any student under the age of 18, a parent or legal guardian must complete the enrollment process, agree to these Terms on the student’s behalf, and provide all required information including emergency contacts and any relevant medical or health conditions.

We reserve the right to refuse or revoke enrollment at our sole discretion if we determine that participation would pose a safety risk to the student, other students, or our staff.
 

3. Assumption of Risk

Martial arts training involves inherent physical risks, including but not limited to bruises, sprains, strains, fractures, and other injuries. By enrolling in our programs or allowing your child to participate, you acknowledge and voluntarily assume all risks associated with participation in martial arts instruction and related activities.

You represent that the student is in good physical health and has no medical conditions that would prevent safe participation, or that you have disclosed all relevant medical conditions to us prior to enrollment. You agree to promptly notify us of any changes in the student’s health or physical condition.

4. Waiver and Release of Liability

To the fullest extent permitted by Oregon law, you agree to release, waive, discharge, and hold harmless Elevate Family Martial Arts, its owner(s), instructors, employees, agents, and volunteers from any and all claims, liabilities, damages, expenses, or causes of action arising out of or related to participation in our programs, use of our facilities, or attendance at our events, including claims arising from the negligence of the released parties.

This waiver applies to you personally and, if applicable, to the minor student for whom you are providing consent. This waiver does not apply to claims arising from gross negligence or willful misconduct.
 

5. Code of Conduct

All students, parents, and visitors are expected to conduct themselves in a manner consistent with the values of respect, discipline, and sportsmanship. The following behaviors are prohibited:

  • Bullying, harassment, or intimidation of any kind

  • Use of excessive force or intentional harm during training

  • Use of profanity or disrespectful language toward instructors, staff, or fellow students

  • Attending class under the influence of alcohol or drugs

  • Damaging school property or the property of others

Violations of this Code of Conduct may result in suspension or termination of enrollment without refund, at our sole discretion.

6. Fees, Payment, and Refunds

Tuition, fees, and payment schedules are established at the time of enrollment and may be updated from time to time with reasonable notice. All fees are due according to the agreed-upon payment schedule. Late payments may be subject to additional charges.

Refund policies, if any, will be communicated at the time of enrollment or as otherwise specified in a separate enrollment agreement. Trial class offers, promotional pricing, and discounts are subject to specific terms that will be disclosed at the time they are offered.

We reserve the right to suspend a student’s participation if their account is past due.

7. Attendance and Scheduling

Class schedules are published on our website and are subject to change. We will make reasonable efforts to provide advance notice of schedule changes, cancellations, or closures. We are not liable for any inconvenience caused by schedule modifications due to weather, holidays, instructor availability, or other circumstances beyond our control.

8. Photo and Video Release

By enrolling in our programs, you grant Elevate Family Martial Arts permission to photograph and record video of students during classes, events, and related activities, and to use such images and recordings for promotional, marketing, educational, and social media purposes without additional compensation. If you do not consent to photography or video recording of yourself or your child, you must notify us in writing at the time of enrollment or at any time thereafter.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Elevate Family Martial Arts or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

10. Website Use

Our website is hosted on the Wix platform and is provided on an “as is” and “as available” basis. We do not guarantee that the website will be uninterrupted, error-free, or free of viruses or other harmful components. You agree not to:

  • Use the website for any unlawful purpose

  • Attempt to gain unauthorized access to any part of the website or its systems

  • Interfere with or disrupt the website’s operation

  • Scrape, crawl, or use automated tools to extract data from the website without our consent.

Our website may contain links to third-party websites, including social media platforms such as Facebook, Instagram, YouTube, and X (formerly Twitter). These links are provided for convenience only. 12. Limitation of Liability

To the maximum extent permitted by Oregon law, Elevate Family Martial Arts, its owner(s), instructors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, participation in our programs, or any transaction conducted through our website, regardless of the theory of liability.

Our total aggregate liability for any claim arising under these Terms shall not exceed the amount of fees you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Elevate Family Martial Arts, its owner(s), instructors, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or related to your breach of these Terms, your use of our website, or your participation in our programs.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Washington County, Oregon, and you consent to the personal jurisdiction of such courts.

Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us in writing. If the dispute is not resolved within thirty (30) days, either party may proceed with formal legal action.

15. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with a revised effective date. Your continued use of our website or participation in our programs after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any separate enrollment agreement, constitute the entire agreement between you and us regarding the subject matter herein and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
